Home owners oftentimes consider selling their home without the assistance of a real estate agent (Realtor) and would like to try to sell their home by owner (commonly referred to as a FSBO – for sale by owner). Also, home buyers are often interested in purchasing a home that is for sale by owner (FSBO). Sellers and buyers who would like to enter into a for sale by owner transaction and who do not have a Realtor to assist them usually have many questions as to how to get the sale and purchase done – after all, without Realtors, who is going to coordinate all of the efforts that are involved? Here are just a few of the questions: What is the first step? What do I need to do in preparation before I take the first step? What do I do when a potential buyer calls? What do I do with the buyer’s deposit check? Who generally pays what closing costs? Do I need a contract prepared? Who prepares the contract? How do I know if the contract is fair? Does the contract protect my rights? How do I know if the buyers are qualified to purchase the home? How do I know if there are any liens on the home? How do I make sure there are no problems with the home before I buy it?
Well, if you are reading this article, you are in luck. An attorney owned title company can assist buyers and sellers with everything that is needed in a for sale by owner transaction from contract to close. Most people are unaware that a title company company is prohibited by Florida law from preparing a real estate sale and purchase contract. I would strongly discourage the use of a sale and purchase contact available at the local home supplies or office supplies store because you think it will save you money. In my experience, these contracts are woefully lacking and insufficient and can expose both sellers and buyers to substantial amounts of monetary damages.
